The Faculty of Law and Political Science discussed a master’s thesis tagged, “The Criminal Liability of the Medical Assistant for Medical Errors”, by the student Ammar Saleh Musa, and supervised by M. Dr.. Ibrahim Shaker Mahmoud.The study aimed to clarify the criminal liability of the medical assistant when he committed a medical error when practicing his profession, as well as to clarify the main rights of the patient in all legislations.The study concluded that the criminal responsibility of the medical assistant is subject in Iraqi law to general rules and there are no special texts to criminalize it, which requires the necessity of organizing it legislatively in clear legal texts, and that Iraqi legislation, like other legislations, did not provide an accurate and reliable definition of medical work, and that the legal basis The legalization of the work of the medical assistant lies in the patient’s consent, which must be true, as well as the absence of criminal intent on the part of the medical assistant, and his intention is to treat the patient, and he must have a license in order to be able to practice the profession.
