The thesis aimed to highlight the opinions of jurists on how to compensate for the damage resulting from arbitrary withdrawal from engagement as well as the position of Iraqi law on it. Highlighting the role of the Iraqi judiciary in punishing those who misuse the right to divorce without reasonable cause, by compensating the wife for the harm caused to her as a result of arbitrary divorce.

The message concluded that the classification of arbitrariness cannot be considered a negligent error or a quasi-negligible error, even if the abuse imposes on the abuser in the use of his right a responsibility that requires compensation for the injured party, but rather abuse is linked to the idea of ​​​​right, so when the abuser exceeds the limits of the purpose of the right, he is considered to have abused his right, and this indicates that this theory is integrated and enjoys a system independent of tort liability.
