The thesis, which was discussed in the presence of the Dean of the College of Law and Political Science, Assistant Professor Dr. Murad Saeb Mahmoud, aimed to define the right to defense and the characteristics of the right to defense and to explain its legal basis in international conventions and constitutions, and to explain the judicial applications to protect the right to defense in the decisions of the Supreme Courts in comparative countries and according to the rulings of the Federal Supreme Court in Iraq.

The thesis concluded that the constitutions and international laws, especially in France and Egypt, stipulated the guarantee of the right to defense, as well as the Constitution of the Republic of Iraq for the year 2005 stipulated the guarantee of the right to defense and many rulings of the Federal Supreme Court in Iraq stipulated it.
