Under the patronage of Professor Dr. Imran Jamal Hassan, President of the University of Kirkuk, and under the supervision of the Dean of the College of Law and Political Science, Assistant Professor Dr. Murad Saeb Mahmoud, and in the presence of the distinguished faculty members and graduate and undergraduate students, the Continuing Education Division in the College of Law and Political Science, in cooperation with the Women’s Empowerment Unit in the college, held a scientific symposium entitled ( The role of the law in reducing the phenomenon of harassment) in the Hammurabi Hall within the college.
The scientific symposium, which was held under the chairmanship of Assistant Professor Hello Muhammad Salih, addressed the role of the law in reducing the phenomenon of harassment, especially the Iraqi Penal Code No. 111 of 1969, as amended, as it did not mention the word harassment at all, but rather included it among crimes against morals and public morals. Article (402) of the Iraqi Penal Code stipulates that: (1- The following shall be punished by imprisonment for a period not exceeding three months and a fine not exceeding thirty dinars, or by one of these two penalties: A- Whoever requests matters that violate morals from another person, whether male or female, B. - Whoever attacks a female in a public place with words, actions or gestures in a way that offends her modesty. 2- The penalty shall be imprisonment for a period not exceeding six months and a fine not exceeding one hundred dinars, if the offender returns to committing another crime of the same type of crime for which the ruling was imposed. The deadline is within one year from the date of the previous ruling.
Also, the effective Iraqi Labor Law No. 37 of 2015 indicated in the second paragraph of Article (11) thereof that: (Anyone who violates the provisions of the articles contained in this law shall be punished by imprisonment for a period not exceeding six months and a fine not exceeding one million dinars, or by one of these two penalties. Separation and related to child labor, discrimination, forced labor and sexual harassment according to each case.
The symposium recommended tightening the penalties contained in the Penal Code, increasing the amount of the fine imposed on the harasser in accordance with the Labor Law, and imposing a fine of up to one million dinars on the harasser.
