A master’s thesis at the College of Law and Political Science at Kirkuk University discussed: The role of the public order principle in the Civil Procedure Code/a comparative study.
The letter submitted by the student: Joan Abdel-Ghani Ali Mardan aimed to shed light on the reasons that provide justification for invalidating some judicial procedures and preventing an imbalance in the legal stability of the opponents’ positions, or even that make the judge obligated to decide on some issues on his own without the opponents’ request.
The thesis concluded that the concept of public order is a relative thing whose circle narrows and expands depending on the degree of development of society and the predominance of social and economic doctrines in it, and that the system of patriarchal authority is the first nucleus of the principle of public order, because the principle of public order, although old, but its content is renewed from time to time.
