In the presence of the Dean of the College of Education for Human Sciences, Professor Dr. Farhad Aziz Mohieddin, the Department of Qur’anic Sciences and Islamic Education discussed the master’s thesis entitled (Jurisprudential Graduation of Contemporary Issues in Contracts Contracts, Collection and Study) by the student Aseel Hamad Khalaf on 3/10/2024 in the college hall.
The thesis dealt with the jurisprudential graduation of emerging issues, facts and calamities in people’s lives that they need in organizing matters of buying and selling and what is related to them, and its purpose is to clarify the legal rulings for those issues related to arrest contracts and present them in an original manner within the conditions and controls of the arrest and its truth, effects and validity so that disagreements and disputes do not arise between them, while I came to the conclusion that some of the contract contracts require payment for their validity, such as the contract of Salam, Mudaraba, and Ijarah, and some of them require receipt of the contract for the necessity and transfer of ownership, such as the contract of loan, gift, and mortgage. Each of these contracts has its own contemporary issues, so the contract of Salam is like a parallel Salam, the Salam at the market price on the day of delivery, the installment contract, and the Mudaraba contract is like mixing funds. Joint Mudaraba, Mudaraba Sukuks, and the bank’s guarantee of Mudaraba risks, the leasing contract such as sublease, lease ending with ownership, and leasing for part of the work, the loan contract such as the employee association, the housing loan, term deposits, the gift contract such as informational gifts, cash gifts of goods, and gifts on the current account, and the mortgage contract such as mortgage of debt, shares, and check.
