**Basis:**
Pursuant to the provisions of paragraph (2) of Article (37) and paragraph (2) of Article (47) of Law No. (40) of 1988 of the Ministry of Higher Education and Scientific Research.
**Article 1:** The student must adhere to the following:
1. Complying with the laws, regulations, internal regulations, instructions, and orders issued by the Ministry of Higher Education and Scientific Research and its institutions (university, authority, college, institute).
2. Not infringing upon religious beliefs, national unity, or nationalistic sentiments, nor deliberately inciting sectarian, ethnic, or religious strife by action or word.
3. Avoiding tarnishing the reputation of the Ministry or its institutions through speech or action, whether within or outside them.
4. Avoiding anything that contradicts disciplined behavior in academia, showing respect to the administration, faculty, staff, peer relationships, and cooperation among students.
5. Maintaining exemplary disciplined behavior that will positively impact them in employment, nominations for scholarships, and study fellowships.
6. Refraining from any action that may disrupt the system, peace, and tranquility within the university campus (college or institute), or participating in it, inciting it, or covering up for those involved.
7. Preserving educational materials and university, authority, college, or institute property.
8. Not disrupting the smooth progress of study in the college or institute.
9. Adhering to the prescribed uniform for students, while considering the specificities of each university or institution separately.
10. Avoiding advocating the establishment of organizations that deepen discrimination or practice any form of political, religious, or social persecution.
11. Avoiding propaganda for any political party, political organization, ethnic or national group, or sectarianism, whether through pictures, banners, posters, or organizing seminars.
12. Not inviting political figures to give lectures or hold political or religious promotional seminars within the university campus to preserve national unity.
**Article 2:** The student shall be disciplined with a warning if they commit any of the following violations:
1. Failure to comply with the prescribed uniform at the university or institution.
2. Insulting or exceeding the peer relationships among students.
**Article 3:** The student shall be disciplined with a warning if they commit any of the following violations:
1. Actions that warrant a warning with prior warning punishment.
2. Disruption of the system, peace, and tranquility in the university, authority, college, or institute.
**Article 4:** The student shall be disciplined with a suspension for (30) thirty days if they commit any of the following violations:
1. Actions that warrant punishment with prior warning.
2. Insulting one of the university affiliates other than faculty members.
3. Defaming a faculty member inside or outside the college or institute.
4. Placing posters inside the university campus that violate public order and morality.
**Article 5:** The student shall be disciplined with temporary expulsion from the university for a period not exceeding one academic year if they commit any of the following violations:
1. Repeatedly committing any of the acts mentioned in Article (4) of these instructions.
2. Engaging in or inciting sectarian, ethnic, political, or party gatherings within the university campus.
3. Assaulting one of the university affiliates other than faculty members.
4. Using violence against fellow students.
5. Threatening to engage in armed violence.
6. Carrying weapons of any kind, with or without a permit, inside the university campus.
7. Deliberately causing or negligently causing damage to the university, authority, college, or institute property.
8. Insulting national unity or religious beliefs.
9. Defaming the university or authority by word or action.
10. Intentionally disrupting the smooth progress of study.
11. Proven involvement in fraud or deception against fellow students or college or institute affiliates.
**Article 6:** The student shall be expelled permanently from the college or institute, with a decision from the university or authority, and their enrollment shall be annulled if they commit any of the following violations:
1. Repeatedly committing any of the violations stipulated in Article (5) of these instructions.
2. Assaulting or inciting against faculty members or lecturers at the university or authority, college, or institute.
3. Committing an obscene act contrary to morals and public ethics.
4. Submitting any forged documents, books, or documents, knowing them to be forged, or being involved in inciting forgery.
5. Proven involvement in an act that disrupts security and tranquility within the university campus or participation in it or aiding it.
6. When sentenced to a crime or misdemeanor that violates honor, with a sentence duration exceeding one year.
**Article 7:**
1. The imposition of disciplinary penalties stipulated in Articles (2), (3), (4), (5), and (6) of these instructions does not prevent the imposition of other penalties if the violation falls under criminal laws.
2. If a criminal lawsuit is filed against the student for an act attributed to them outside the university or institute, the disciplinary consideration shall be deferred until the criminal case is decided.
**Article 8:** The Dean of the College or Institute shall constitute a Student Discipline Committee, chaired by the Vice Dean and composed of two faculty members, one of whom must be a legal member. A representative from the Student Union (elected) and an administrative employee shall also be appointed to perform the committee's secretarial duties.
**Article 9:** No disciplinary penalty may be imposed unless recommended by the Student Discipline Committee.
**Article 10:** Disciplinary penalties stipulated in these instructions shall be imposed by a decision of the College or Institute Council, and the Council shall delegate its powers to the Dean of the College or Institute.
**Article 11:**
1. The penalties of warning and reprimand are final.
2. The student expelled from the college or institute for a period not exceeding (30) thirty days may object to the expulsion decision before the College or Institute Council, and its decision shall be final.
**Article 12:** The student may object to the decisions of expulsion stipulated in paragraphs (2), (3), and (4) of Article (11) of these instructions within (7) seven days from the date of being notified of the decision issued against them. If notification is impossible, the student has the right to object within (15) fifteen days from the date of publication of the expulsion decision on the notice board.
**Article 13:** The disciplinary penalty decision shall be suspended on the notice board in the college or institute for a period not less than (15) fifteen days, and the student's guardian shall be notified in writing.
